Unpaid note subject of suit

Michael Guide filed a breach of contract suit against Anthony Kemper and Kemper Brothers Enterprises in Madison County Circuit Court Nov. 30, claiming the defendants failed to pay a promissory note.

According to Guide, he loaned the defendants $110,000 on Nov. 4, 2005, and they agreed to make payments of $731.83 until the principal and interest were paid.

Guide claims the defendants have failed to make a payment since September and pursuant to the note if the loan is in default for more than 30 days, the entire amount outstanding, accrued interest and late charges become immediately due.

Represented by John McCracken and Joy Krohne of Edwardsville, Guide is seeking $110,416.33, plus interest, court costs and attorney fees.
