Keeley & Sons, driver named in wrongful death complaint

Joyell Lindley filed a wrongful death complaint against Keeley & Sons and its truck driver Larry J. Benesh over a fatal accident last year that claimed her father's life.

According to a lawsuit filed July 31 in St. Clair County Circuit Court, James Lindley was driving in a northwesterly direction on South Main Street in Dupo when it was struck in the side by Benesh's truck which was westbound on Industrial Drive.

The incident took place Sept. 15, 2006.

Represented by Timothy J. Bates of Belleville, Lindley is seeking in excess of $300,000 in compensatory damages and for medical, funeral and burial expenses.

The suit claims James Lindley, who was 51 at the time, suffered severe and permanent injuries to his head, neck, back, arms, hands, legs, feet, internal organs and to his body generally. He died within hours of the collision, the suit claims.

James Lindley left three surviving children, Joyell Lindley, Jolene Watson and Jason Calhoun.
