Phenobarbital overdose claimed in suit against pharmacy

A Washington Park pharmacy is being sued by a woman who claims a druggist provided the wrong dosage of an anti-seizure medicine to a child which caused an overdose.

Donna Cox, guardian of Cheyanne Rogers, a minor, claims Medicate Pharmacy refilled a Phenobarbital prescription for Rogers on April 28 with 60 mg tablets instead of 16.2 mg tablets.

She claims that Rogers was admitted to the emergency room at St. Louis Children's Hospital on May 10 with a principal diagnosis of Phenobarbital overdose/toxicity, hypercapnia, acidosis, altered mental state and right lung collapse.

According to the complaint filed July 16 in St. Clair County Circuit Court, Cox had been purchasing the medicine from Medicate for a period of time and the order was not an original prescription.

"...Plaintiff has been required to undergo reasonable, necessary and extensive medical, surgical, hospital, nursing, therapeutic and rehabilitative care and treatment for which charges were made," the complaint states.

Represented by Matthew J. Sauter of Sauter Sullivan LLC in St. Louis, Cox is seeking in excess of $50,000 in damages.
