A woman who slipped and fell three separate times on ice, snow and water at the Cottonwood Mall in Glen Carbon filed a personal injury suit seeking damages in excess of $150,000.
According to a suit filed by Nancy Heil against THF Glen Carbon Development, LLC, the incident took place on Feb. 13.
Represented by Tom Maag of Edwardsville, Heil claims she was entering Cottonwood when she slipped and fell on snow and ice.
"Plaintiff got up, and again, slipped and fell on snow and ice," the complaint filed May 30 in Madison County Circuit Court states.
Heil claims the snow and ice that she slipped on was not a natural accumulation, but rather, an unnatural accumulation caused by the runoff from the building and snow and ice accumulating along the building and outlying fixtures.
The third alleged fall happened inside when she slipped on a puddle of water on the floor which may have dripped from a leak in the roof.
Heil claims THF failed in its duty to use reasonable care for the maintenance of its premises.
She claims the three falls caused her to suffer hand and head injuries that caused her to become liable for medical expenses, lose wages and income, suffer pain and the ability to live a normal life.
The case has been assigned to Circuit Judge Daniel Stack.
