Gateway Regional Medical Center

The estate of Eddie Barbee filed a wrongful death suit against Gateway Regional Medical Center and three doctors in Madison County Circuit Court Jan. 19.

According to the complaint, Barbee went to the emergency room at Gateway on Jan. 16 and Jan. 19, 2005, with complaints of abdominal and back pain.

Barbee was treated by Scott Anderson, M.D. and Jeffrey Arendell, M.D. and M. Mandis, M.D.

The estate claims the hospital and the doctors breached the duty of care owed to Barbee and that they deviated from the accepted standard of care owed to Barbee.

According to the complaint, Gateway and the doctors negligently and carelessly failed to compile an adequate medical history on Barbee, failed to conduct a thorough and complete investigation, failed to investigate for appendicitis, failed to perform appropriate tests and failed to correctly interpret tests that were performed.

The estate also claims the defendants failed to properly diagnose appendicitis, failed to admit Barbee to the hospital, carelessly discharged Barbee from medical care and treatment and otherwise negligently provided medical care and treatment to Barbee.

The estate alleges that Barbee's condition went undiagnosed causing him to suffer from a diseased and ruptured appendix which resulted in sepsis secondary to peritonitis, hypertension, shock and renal failure which caused Barbee's death on Jan. 22, 2005.

Barbee's estate claims that prior to death, he experienced conscious pain and suffering for an extended period of time and incurred substantial expenses for medical treatment.

The estate claims that Barbee's untimely death caused the next of kin to sustain a loss of society and companionship, loss of future financial support and to incur expenses for funeral and burial expenses.

Represented by John Papa of Callis, Papa, Hale, Szewczyk & Danzinger of Granite City, the estate is seeking damages in excess of $200,000, plus costs.

The case has been assigned to Circuit Judge Andy Matoesian.
