Motomart blamed for customer's oily trip

A customer of Motomart is suing the service station for slipping, tripping and falling on oil, gasoline or another slippery substance "through no fault of her own."

Merlee Hudson claims injuries to her right arm, left arm and hands in a suit filed Jan. 12 in St. Clair County Circuit Court. The incident took place outside the gas station at 1324 North Illinois St. in Swansea on Jan. 13, 2005.

"Defendant...should have expected that the plaintiff would not discover or realize the presence of the dangerous oil, gasoline or other slippery substance on the said premises, or that plaintiff would fail to protect herself against the said danger," the complaint states.

The suit names FKG Oil, doing business as Motomart, as well as John and Jane Doe.

Represented by Rhonda D. Fiss of Belleville, Hudson is seeking in excess of $50,000 in damages.
