School lunch not fit for human consumption, suit claims

A Cahokia School District 187 employee claims he damaged his teeth as well as the bones, muscles and tissues of his jaw and face after biting into a polish sausage he was served at a school cafeteria last year.

In a suit filed against the district in St. Clair County Circuit Court Jan. 12, Lawrence Butler says the sausage contained a bone or other foreign fragment.

The food he ate on Jan. 18, 2006, was contaminated, adulterated and not fit for human consumption, the suit claims.

Butler claims he sustained severe and permanent personal injury, lost large sums of money in and about securing medical and dental care and lost wages and benefits that he might otherwise have gained through his employer.

Represented by William S. Beatty of Beatty & Motil in Glen Carbon, Butler is seeking in excess of $100,000 in damages.

Among other things, Butler claims the school district's conduct was willful and wanton in that it failed to warn him that the polish sausage as sold contained bone or other foreign substances.
