Waterloo homeowners sue contractors over flue pipe

Jim and Tonya Hearty of Waterloo are suing Thermal Concepts, Inc. of Clayton, Mo. and Kelly Homes, Inc. of St. Louis claiming a negligently installed flue pipe in their wood-burning chimney resulted in a home fire and personal injuries.

According to the suit filed Dec. 28 in St. Clair County Circuit Court, a fire that occurred on Dec. 28, 2004, caused approximately $88,286.19 in damages.

Jim Hearty suffered injuries to his back, including disc protrusion, the suit states.

Represented by Christopher S. Hoffman of the Hoffmann Law Firm in St. Louis and by Robert Cockerham of Brown & James in St. Louis, the Heartys are seeking in excess of $100,000 for injuries and damages.

The suit claims the defendants failed to install an insulation shield that maintains the proper clearance between the chimney and the blown-in cellulose insulation.
