Med mal suit filed against Alton Memorial and physicians

The estate of Clover Fry filed a medical malpractice suit against Matthew Duban, M.D., Sadiq Mohyuddin, M.D. and Alton Memorial Hospital claiming the defendants failed to diagnose Fry's pulmonary embolism on Nov. 13, 2004.

According to the complaint filed Nov. 8 in Madison County Circuit Court, Fry was admitted to Alton Memorial due to shortness of breath, abdominal discomfort with pain in the epigastric region and nausea.

The estate claims Duban, the emergency room physician, failed to recognize the signs and symptoms of a pulmonary embolism, failed to timely follow up on test results and failed to order appropriate testing for pulmonary embolism.

Fry's estate claims Mohyuddin, Fry's treating physician, carelessly and negligently failed to order immediate evaluation for pulmonary embolism and failed to order additional cardiac evaluations when Fry developed tachycardia and shoulder pain on Nov. 14, 2004.

According to the complaint, the nursing staff at Alton Memorial failed to notify Mohyuddin of Fry's deterioration manifested by persistant tachycardia, low oxygen saturation and development of diaphoresis.

The complaint states that Fry was injured both internally and externally, suffered severe and permanent injuries, was exposed to continued abdominal distention, shortness of breath, and sudden onset of slurred speech and blowing respirations, which resulted in multi-symptom organ failure and death.

The estate also claims Fry suffered acute and prolonged physical and mental pain and suffering, became liable for great sums of money for medical, hospital care and treatment, as well as incurred other expenses.

Represented by John J. Hopkins of Edwardsville, Fry's estate is seeking damages in excess of $200,000, plus all costs of the suit.
