Former Madison County Circuit Judge Phillip Kardis was sued in the court where he once presided by a tenant who claims she injured herself in an East Alton apartment parking lot he owns.
Nancy Wiegand filed suit July 31 claiming an unreasonably dangerous condition existed at the Diplomat Apartments on Kent Street because a large piece of rebar metal protruded from the concrete pylon #339D in front of her vehicle.
On May 5, 2005, Wiegand alleges she struck the rebar and fell after exiting her car. She is represented by Eric Kirkpatrick of Belleville and is seeking in excess of $150,000, plus all costs of the suit.
Kardis, who used to sit in judgment in cases involving allegations of slips and falls, retired from the bench last fall.
Wiegand alleges Kardis:
According to the complaint, Wiegand suffered serious and permanent injuries, became liable for medical expenses, endured a great deal of pain and emotional suffering, lost large amounts of earnings and wages and has suffered the loss of a normal life.
Daniel Wiegand, Nancy Wiegand's husband, also is seeking damages from Kardis alleging his wife's injuries have permanently deprived him of her love, companionship and support.
The case has been assigned to Circuit Judge Andy Matoesian.
