Fifth wheel on FedEx truck blamed for injury

A truck driver transporting items for Federal Express filed a personal injury suit in Madison County Circuit Court June 30, alleging the courier failed to maintain its equipment in a reasonably safe condition.

David Hartley claims he sustained injuries on July 2, 2004, when he attempted to disengage the fifth wheel on the FedEx vehicle he was assigned.

According to the complaint, Hartley, an employee for Steve Crawford Trucking, was provided FedEx vehicles and was required to wear to FedEx uniforms.

Hartley claims FedEx failed to maintain a locking mechanism, failed to replace the damaged locking system, and failed to warn users of the damaged condition of the locking mechanism on the fifth wheel.

According to Hartley, he injured his right arm, shoulder and left knee and was required to seek medical attention for his injuries resulting in substantial medical expenses.

He also claims he suffered pain of body and mind and lost sums of money that he would otherwise be able to make as an able-bodied person.

Represented by Samuel Mormino, Jr., of Mormino, Velloff, Edmonds & Snider of Alton, Hartley is seeking damages in excess of $100,000, plus all costs of the suit.
