Resident sues O'Fallon over broken sidewalk

Diane Truran of O'Fallon is suing the City of O'Fallon over a broken sidewalk which allegedly caused her to suffer head, face and mouth injuries.

Seeking in excess of $50,000 for pain and medical expenses, Truran is represented by Michael P. Murphy of Freeark, Harvey, Mendillo, Dennis, Wuller, Cain & Murphy of Belleville.

Truran claims she tripped and fell on a sidewalk near the intersection of Smiley Street and Highway 50 in O'Fallon on Oct. 3, 2005.

According to the complaint, the city is negligent for permitting the sidewalk to remain in a broken condition for an unreasonably long period of time, for failing to inspect, maintain and repair the sidewalk, as well as for failing to warn pedestrians of the hazardous conditions posed by the sidewalk.
