O'Fallon woman sues auto dealer for bad brakes on used vehicle

An O'Fallon woman filed suit against Auffenberg St. Clair Auto Mall claiming that seven days after she purchased a used vehicle, the brakes failed causing her to sustain serious injuries.

According to the complaint, Tina Sammons purchased a 2001 Mazda B3000 Dual Sport Cab Plus on May 31, 2005.

Sammons claims at the time of the sale, Auffenberg told her that a pre-sale inspection had been performed.

She then claims that on June 7, 2005, the brakes failed and she became injured after being tossed to and fro in the vehicle.

Sammons filed suit March 16 in St. Clair County Circuit Court seeking damages in excess of $50,000. She is represented by Greg Shevlin of Belleville.

Sammons alleges that Auffenberg failed to adequately perform a pre-sale inspection, failed to properly install new brakes prior to the sale, failed to replace bolts holding the caliper and failed to adequately torque the bolts on the caliper.

According to Sammons, she suffered injuries to her neck, back and body as a whole that caused great pain and mental anguish, a loss of wages, and liability for medical expenses.
