Reshelle Summers, as personal representative of the estate of Mary Carter, is suing a slew of public officials and entities over an auto accident death last year in East St. Louis.
Summers claims Carter was a passenger in Sharmiko Brown's vehicle when it went into an icy skid and overturned on eastbound St. Clair Avenue in East St. Louis on Feb. 25, 2005.
The lawsuit, filed Feb. 23 in St. Clair County Circuit Court, names the city of East St. Louis; Michael Smith, city sewer department superintendent; Jessie Walker, public works director; the village of Washington Park; Jody Gomiller, public works director in Washington Park; Canteen Township and Carl Gomez, highway commission for Canteen Township.
The 14-count suit seeks damages for wrongful death and survival action.
The complaint states that the defendants failed to keep drains, storm sewers and roadways clean and clear in the area where the accident took place.
"...Ice collected on the aforesaid roadway, which roadway was otherwise clear of precipitation and which ice was not readily visible to traffic traveling in an easterly direction on St. Clair Avenue," the complaint states.
According to Summers, Carter suffered head, neck, torso, chest and extremities injuries which "directly and proximately" caused her death.
