Olin sued for breach of contract

Kathy Denny filed suit against Olin Corp. seeking damages in excess of $50,000 alleging Olin is in breach of contract after refusing payment on a long-term disability policy.

According to the suit filed Feb. 14 in Madison County Circuit Court, Denny claims Olin stopped making its disability payments nine months before she started receiving Social Security disability payments in March 2005.

Denny claims she has been disabled since Sept. 19, 2002.

According to the complaint, Denny is not in possession of a copy of the long-term disability contract, but she has complied with all the requirements and conditions of the policy.

"Denny has made demand of payment for said disability under the long-term disability policy, but Olin has breached said contract by refusing payment as provided under said policy," the complaint states.

Denny also claims Olin's actions and delays have been vexatious and unreasonable entitling for attorney fees and other costs provided by statute.

She is represented by Lance Mallon of Wood River.
