Joseph Grass filed suit against T.R.'s Place in St. Clair County Circuit Court Dec. 15, claiming he sustained serious injuries at the tavern because the building was not up to code.
Grass claims that on March 13, 2005, he was attempting to exit through a door on the east side of the building when he was caused to trip and fall, injuring his head and neck.
According to the complaint, T.R.'s was in violation of the BOCA National Building Code by allowing and permitting stairs which do not meet code. Grass claims that the riser height on the stairs exceeded seven inches and was less than the minimum tread depth of 11 inches.
Grass also claims the floor elevation drops down to a step rather than remaining at the same level as inside the door. He alleges that T.R.'s failed to provide a handrail.
Grass claims the injuries he sustained have caused him to suffer great physical pain, mental anguish and loss of a normal life.
Represented by Matthew Marlen of Belleville, Grass is seeking damages in excess of $50,000 for the injuries he allegedly sustained.
