Deandre Commons filed suit against Southern Illinois Health Care Foundation (SIHCF) and two employees in St. Clair County Circuit Court Sept. 30, alleging private medical information was wrongfully disclosed to his employer.
According to the complaint, Commons was caused extreme mental and physical injuries because the defendants, Yolanda Gore and Lamant “Doe,” allegedly breached the physician-patient relationship by releasing private information without consent on Oct. 4, 2004.
Commons claims SIHCF failed to adequately train employees to prevent the release of private medical information and failed to ensure his medical information was confidentially maintained and protected.
“Commons' image and reputation in the community was defamed and slandered and his reputation was irreparably harmed,” the complaint states.
Commons claims he has lost time from his regular business or employment, though the exact amount is unknown.
“Defendants caused intentional infliction of emotional distress to Commons,” the complaint states.
Commons, represented by Lynn Fischer of Clayton, is seeking damages in excess of $350,000, plus all costs of the suit.
