Two 'Jones Act' cases filed in federal court

David Hill filed a Jones Act lawsuit in U.S. District Court on Sept. 9, against Kirby Inland Marine claiming he suffered injuries on Nov. 20, 2004.

Hill places blame with Kirby for the injuries he sustained while packing rigging over excessive distances for a prolonged period of time. Kirby failed to provide him with a safe place to work, Hill claims.

According to Hill's complaint, he suffered pain and suffering, mortification, humiliation, fright, shock, and embarrassment, hospital expenses, aggravation of a prior injury, and has been unable to engage in social, recreational and other pursuits he previously enjoyed.

Hill is seeking a trial by jury and a judgement against Kirby in an amount to be determined at his trial. He is represented by Dennis O'Bryan, of Birmingham, Mich. The case has been assigned to Judge Patrick Murphy.

In another federal filing, Chris Baum alleges his employer, Delta Queen Steamboat Company, was negligent for injuries he sustained at work.

Baum was injured after he stumbled on a green deck that was allegedly not properly lit, which caused him to fall on a darkly and improperly painted green chair on Feb. 16, 2003, his complaint states.

He also claims he injured himself again on the Delta Queen on March 29, and his employer allegedly arbitrarily refused to pay him maintenance and cure as a result.

Like Hill, Baum--who is represented by O'Bryan--claims he suffered pan and suffering, mortification, humiliation, fright, shock, and embarrassment, hospital expenses, aggravation of a prior injury, and has been unable to engage in social, recreational and other pursuits he previously enjoyed.

Baum's case has been assigned to federal judge Michael Reagan.

Neither complaint specifies specific injuries.
