Alleging permanent injuries to her right shoulder. Barbara Montgomery filed suit against Wal-Mart in St. Clair County Sept. 1 because the retailer failed to properly stack merchandise.

Montgomery claims that on Nov. 25, 2003, Wal-Mart created a foreseeable risk to others by allowing unstable merchandise on its shelves. She also claims the store failed to warn her of the risk.

According to the complaint, Montgomery suffered great pain and mental anguish, incurred medical expenses and has lost and will continue to lose "great gains and profits" she otherwise would have acquired.

Montgomery is represented by Grey Chatham of Belleville. The suit does name the store where Montgomery was injured.
