Belleville physician named in wrongful death before reform enacted

A second wrongful death suit was filed in St. Clair County Circuit Court just days before the state's medical liability reform bill was signed into law.

According to a complaint filed Aug. 19, Marietta Claypool claims Belleville physician John Boeren, M.D. failed to treat her husband for rhabdomyolysis, even though he displayed aching symptoms consistent with the disease.

James Claypool, Jr. died March 1.

Rhabdomyolysis is the breakdown of muscle fibers resulting in the release of muscle fiber contents into the circulation. Some of these are toxic to the kidney and frequently result in kidney damage.

According to the National Institute for Health, symptoms include muscle weakness and tenderness, a dark red or cola colored urine and muscle stiffness or aching.

Claypool claims she has been permanently deprived of her husband's love, companionship, society and support, and has became liable for medical and funeral expenses.

She is seeking a judgement in excess of $300,000 plus all costs of the suit. Claypool is represented by Thomas Keefe of Belleville.
