A five-year-old class action case filed against Allstate Insurance will be in court June 29 for a case management conference with Circuit Judge Nicholas Byron presiding.
Filed by Dennis Strasen in late 1999, the suit accuses Allstate of violating the Illinois Consumer Fraud Act(ICFA) by reviewing its policy holders' medical bills using claims-auditing software, and then refusing to pay some of the bills on the basis of them being "unreasonable."
Strasen contends that all medical bills and treatment are reasonable because they were performed by a licensed medical provider.
In October 2004 Byron denied a motion to dismiss the case.
Allstate claims that Illinois courts have expressly allowed insurers to review medical bills using the very type of computer database toward which Strasen directs his complaint.
