Railroad worker sues employer and lawyers

A railroad worker filed suit in St. Clair County Circuit court June 9 against his employer and former attorney over a workplace injury that occurred on Aug. 20, 2002.

Terry Russell claims his employer Illinois Central Railroad (ICR) failed to provide him with a safe place to work and safe equipment.

According to the complaint, Russell suffered disabling and disfiguring injuries to his leg and knee, suffered permanent pain mental anguish, lost wages and became liable for medical expenses when a handle failed while he was attempting to throw a switch.

Russell was a maintenance of way employee who performed track maintenance in St. Clair County.

He also claims that his former attorneys, Burge, Wettermark, Holland & Barber, failed to file a products liability claim within the applicable statute of limitations against the manufacturer of the switch.

Russell, represented by Thomas Keefe, is seeking at least $150,000 in damages plus all costs of the suit.
