Doctor and hospital named in new med mal suit

Robert Schultz, M.D. and Belleville Memorial Hospital are the targets of a medical malpractice lawsuit filed by Franklin County resident Curtis Eubanks in St. Clair County Circuit Court May 16.

Eubanks claims he lost vision in both eyes after Schultz performed a cervical myelogram at Memorial Hospital on June 18, 2002--but failed to advise him of the dangers of the procedure before the operation.

He originally filed suit on June 17, 2004, and then voluntary dismissed it on Sept. 17, 2004. Pursuant to the order, he has brought the suit within one year of the dismissal.

A myelogram is a specific X-ray study that uses an injection of a dye or contrast material into the spinal canal to allow careful evaluation of the spinal canal and nerve roots.

Eubanks claims that had the normal results of the two non-invasive tests been available for review and consideration, the cervical myelogram would not have been medically indicated.

According to the complaint, Eubanks claims he suffered unnecessary pain as a result of the procedure, lost enjoyment of life, and pain and suffering due to his loss of vision.

Eubanks, represented by Bryan and John Drew of Drew & Drew in Benton, is seeking at least $150,000, plus all costs of the suit.
