Waggoner Equipment seeks to recover for damaged crane

Wood River-based Waggoner Equipment Company filed suit in Madison County Circuit Court May 3 seeking $125,000 in damages from United Rental and Union Electric claiming the defendants damaged a crane.

Waggoner is represented by Donald Smith of Hoagland, Fitzgerald, Smith & Pranaitis of Alton.

According to the complaint, United rented the crane to Union Electric for use at its Rush Island plant on Jan. 8, 2004. During UE's use of the crane, it was overloaded and sustained major structural damage to the frame, superstructure, boom and turnable bearing of the crane.

United Rental, which leased the crane for $3,000 per month, agreed to be responsible for any damage and agreed to provide appropriate insurance, according to the lease agreement of Oct. 23, 2003.

Waggoner claims it had to spend $92,000 for the repair and replacement of the crane which took 11 months, depriving them of $33,000 in rental income.

"Waggoner has demanded total damages from United Rental pursuant to the rental agreement, and the defendant failed to pay damages," the complaint states.

The case has been assigned to Circuit Judge Philip Kardis in Granite City.
