The victim of a fight during an unsupervised flag football game at O'Fallon Township High School on March 16, 2004, filed suit against the school and the instigator.

According to a suit filed March 15 in St. Clair County Court, Douglas Kuehl alleges that Santoin Russell struck him in the back of the head with his fists.

"The conduct of Russell demonstrated an intention to cause harm to Kuehl or in the alternative demonstrated utter indifference to the safety of Kuehl," the complaint states.

Kuehl is seeking a judgment against Russell in excess of $50,000, plus all costs of the suit.

He also is seeking punitive damages from Russell to punish him for "willful and malicious intent to injure."

In the suit, Kuehl also is seeking at least $50,000 in damages from the high school, claiming OTHS failed to provide adult supervision during the flag football game when authorities should have known that an unreasonable risk of harm was present based on Russell's prior acts of misconduct while enrolled at OTHS.
