Billy J. Morber filed a lawsuit seeking at least $50,000 in damages against R.P Lumber in St. Clair County Circuit Court Feb. 25.

Morber, who is represented by Brad Badgley of Belleville, claims he was struck by a bundle of rebar being delivered by an R.P. Lumber truck on Dec. 30, 2004. At the time, Morber was employed by Madura Concrete as a concrete form setter at a residential construction project near Lebanon.

In the complaint, Morber claims that R.P. was negligent by failing to lower or tilt the bed of the truck to facilitate removal of the bundle of rebar. He also claims that R.P failed to warn him not to handle the rebar while it remained in the truck.

Morber claims he has sustained injuries to various parts of his body causing him pain, permanent disability and disfigurement. He also states he has become obligated for medical bills and lost wages.
