Schnuck's aisle 13 mishap leads to $50k suit

Aisle 13 proved hazardous for East St. Louis Schnuck's customer Larry Helm after he slipped and fell on a wet substance Dec. 8, 2004, sustaining severe injuries to his neck, shoulder and low back.

Helm, represented by attorney Thomas C. Rich of Fairview Heights, filed suit against Schnuck Markets, Inc. on Feb. 4 in St. Clair County Circuit Court. He is seeking in excess of $50,000 in damages.

According to Helm's suit, he was "made sick, sore, lame, disordered and disabled and suffered extensive injuries to his head, body and limbs, both internally and externally.

"He has experienced pain and suffering and will be reasonably certain to experience pain and suffering in the future as a result of the injuries," according to the complaint.

Helm alleges that the Schnuck's grocery store, located at 2511 State St., was negligent for the following reasons:

  • It failed to manage, inspect, clean and maintain its premises in a safe condition;

  • It managed its store in such a manner as to allow the floor to be wet in an area where customers usually walk; and

  • It failed to place warning signs or cones in a manner visible to customers in the area to warn customers of a substance on the floor.
