Alton & Southern Railroad named in St. Clair

By Ann Knef | Feb 8, 2005

The Alton & Southern Railway Co. was named in two Federal Employers' Liability Act lawsuits filed recently in St. Clair County Circuit Court.

Machine operators Willie J. Dickerson and Danny Chapman filed nearly identical complaints seeking more than $50,000 each for injuries to their back, neck, spine, shoulders, legs and body.

They are both represented by East Alton attorney Gregory M. Tobin.

According to their complaints, the trackmen were subjected to numerous repetitive trauma and walking on unstable ballast while repairing tracks. Their injuries caused them to suffer pain and mental anguish, lost earning potential and medical expenses.

Chapman, who filed suit Feb. 3, was employed by Alton & Southern Railway from 1973 through 2003. Dickerson filed suit Jan. 31 and worked for the railroad from 1986 to 2000.

They claim the railroad was negligent for failing to provide:

  • A reasonably safe place to work;

  • Safe methods of work;

  • Sufficient manpower; and/or

  • Safe tools and equipment
