General Motors and Four Flags in court

General Motors and Four Flags auto dealership in Glen Carbon, who are accused of overcharging customers for extended warranties, will be in court Dec. 29 on plaintiff's motion to compel discovery. Circuit Judge Andy Matoesian will preside.

Christopher Booher of Wood River filed the class action lawsuit Dec. 4, 2001. Represented by Daniel Cohen of The Lakin Law Firm of Wood River, Booher claims he was charged too much for an extended warranty when he purchased a car from Four Flags in 1998.

General Motors is represented by Kirkland & Ellis of Chicago. Four Flags has retained defense counsel, Dunham, Bowman & Leskera of Collinsville.

Matoesian recently heard arguments regarding the class certification but has yet to rule on whether he will certify the case as a class action.

Four Flags, which sells General Motors vehicles, operates a car dealership in Glen Carbon on Highway 159. The dealership has been named in eight class action lawsuits in Madison County, including another filed by Booher. That case was dismissed in November 2003 by Circuit Judge Nicholas Byron.

Booher also filed a class action suit in 2001 against Four Flags and United Life Insurance. However, Four Flags was dismissed from the complaint. United Health Care is awaiting trial in the case that Judge Kardis certified as a class action.
