Kentucky company seeks justice in Madison County

Stephens Pipe and Steel of Russell Springs, Ken. filed suit against Clarence A. Jack Dempsey, owner of Granite Inc., seeking to collect an unpaid debt of $289,623 plus interest. The suit was filed in Madison County Circuit Court on Dec. 6.

Granite Inc. filed bankruptcy Nov. 5 in the Southern District of Illinois Bankruptcy Court.

Stephens Pipe claims Granite Inc. has not paid for certain goods or services that total $289,623. According to the complaint, Dempsey personally guaranteed the payment, which makes him the subject of the lawsuit.

Stephens Pipe and Steel is represented by Gary R. Underwood of the Underwood Law Firm in St. Louis.

Granite Inc. has been named as either a plaintiff or defendant in at least eight separate cases in Madison County, mostly small claims.

This is the first time Stephens Pipe & Steel has ever been named in a lawsuit in Madison County. The suit also seeks to recover reasonable attorney fees and court costs.

The case has been assigned to Circuit Judge George Moran Jr.
