A breakdown of last week

Ronald W. Poor v. Sprint Corporation

  • A civil jury trial has been set May 16, 2005, with Circuit Judge Phillip Kardis presiding.

    Michelle R. Lamczyk v. Dollar General
  • The court having fully considered the parties' stipulation to dismiss; orders that cause number 02 L 856 is dismissed with prejudice with each party to bear its own attorney fees and costs.

    Richard Disher ind. and on behalf v. Citigroup
  • A case management conference was held by telephone with both parties.

    Cynthia Hoffman ind. and on behalf v. State Farm
  • A class certification hearing has been set for June 27, 2005, at 9:30 a.m. in Granite City. Circuit Judge Phillip Kardis will preside.

    Big Sky Excavating v. Illinois Bell Telephone & Ameritech dba SBC Midwest
  • Judge Kardis ruled that 220 ILCS 5/13-502.5(a-f) violates the provisions of the Illinois Constitution article IV and articles I and II. He further ruled that this declaration of unconstitutionality has no effect on the remainder of the act. As to pleadings, plaintiff's motion for partial summary judgment is granted, and defendant's motion to dismiss is denied. A notice of appeal and filing was filed by both defendants and a copy of the appeal was mailed to the appellate court. The appeal was sent to the appellate court in error, and Madison County phoned the appellate court to inform them that the appeal should have been sent straight to the Supreme Court. The appellate court gave the case docket number 5-04-0647 and a due date of Dec. 7.

  • Defendant's motion for reconsideration of court's order denying its motion to dismiss for lack of personal jurisdiction, heard and denied. Plaintiff's motion to compel deferred pending further 201 (K)efforts.

    Darryl Johnson ind. and on behalf v. First Banks
  • The motion hearing set for Oct. 26 was cancelled by Judge Phillip Kardis due to Lakin Law Firm amending the complaint.

    Douglas Pichee ind. and on behalf v. Delta Funding
  • The case management conference was held and discovery schedule was set, however, the defendant's motion to dismiss was continued and a further case management conference is to be set on first available date after the ruling on the motion to dismiss.

    Ashley Peach v. Fashion Bug
  • October 27 hearing cancelled based on plaintiff's leave to amend complaint.

    Darren Kuhn v. Petco Animal Supply
  • A Nov. 7 hearing has been set for a forum non conveniens dismissal motion filed by Petco. It will be heard at 9:30 a.m.

    Deanna Neubauer v. Intel, Gateway, Hewlett Packard
  • Intel was granted leave to substitute exhibit B of its response to plaintiff’s motion for reconsideration of the July 12 order for class action certification.

    Robert Schultz M.D. William Sprich M.D. v. Cigna
  • Judge Nicholas Byron held a case management conference Oct. 27.

    Molly Alter v. Starbucks
  • Judge George Moran set a motion hearing for Nov. 24 at 9:30 a.m. for Starbucks' motion to dismiss. A case management conference will also be held that day.
