Collection firm demands couple repay note

A West Virginia corporation acting as a collection firm filed suit against a Madison County couple for alleged breach of contract in 2006.

Kevin W. Harper Investments Inc. brought a complaint April 6 in Madison County Circuit Court against Darrin S. Lancaster and Kristine D. Lancaster, claiming default on a loan originating in July 2006.

According to the suit, the defendants entered into a July 25, 2006, agreement with AFS Financial Inc. of Bethesda, Md., for a promissory note in the original amount of $60,000, with mutually approved provisions to repay with interest via monthly installments of $734.64, due on the first of each month, beginning Sept. 1, 2006.

The promissory note was transferred several times over to additional companies and ultimately was assigned to the plaintiff for collection on Jan. 6, 2014. The complaint alleges that the note is in default.

Harper Investments seeks to recover a balance allegedly owed of $106,889.15, plus interest accruing at the rate of $20.06 per day for each day following March 20, 2015; plus attorneys’ fees and costs.

The firm is represented in the case by Emmet Fairfield of Brown, Hay and Stephens of Springfield.
