Madison County jury reaches verdict in favor of Alton doctor

A Madison County jury entered a verdict in favor of an Alton doctor in a medical malpractice case that alleged the doctor negligently attempted to repair a patient’s left inguinal hernia with mesh.

The four-day trial ended in Circuit Judge William Mudge’s courtroom Feb. 20 after two hours of deliberations.

Plaintiff Kevin Doe filed his two-count complaint on May 27, 2011, against Dr. Maudie M. Miller, a physician and general surgeon with Alton Multispecialists, Ltd, Inc. The suit claimed that on May 21, 2009, Doe consulted Miller to treat a recurrent left inguinal hernia. One week later, Doe says he was admitted to an ambulatory surgery department at Alton Memorial Hospital where Miller attempted to surgically repair his hernia with mesh.

Miller continued to provide post-surgery care to Doe until June 18, 2009. He was permitted to return to work on June 22, 2009, with no restrictions.

However, Doe claims he suffered a recurrence of his left inguinal hernia in February 2010 as a direct result of Miller’s alleged “substandard” care.

Doe accused Miller of negligently and carelessly failing to adequately evaluate the plaintiff post-operatively, releasing Doe prematurely in June 2009 with an open wound, releasing him to return to work without restrictions when his surgical wound was not healed, releasing him to return to work without restrictions with she knew that the nature of his work was likely to cause her surgical repair to fail and negligently treating Doe.

The plaintiff sought $50,000 for each count in the complaint.
