Route 159 accident in Maryville leads to suit

A man has filed suit against the driver whom he alleges caused a collision.

Victor Ahart field the lawsuit suit filed Feb. 4 in Madison Circuit Court against Anntanette R. Collins and Walter Minor.

According to the complaint, Victor Ahart was riding in a motor vehicle traveling north on state Route 159 at its intersection with state Route 162 in Maryville on Feb. 11, 2013, at about 2:41 p.m. when Collins, who was driving south on Route 159, attempted to make a left-hand turn. In the midst of the turn, she struck the vehicle in which Ahart was riding, the suit states.

Because of the collision: Ahart became sick, sore, lame, disordered and disabled; suffered injuries to his neck, back and shoulder; and incurred medical costs, the suit states. He also suffered disability, experienced pain and suffering and lost wages, the suit states.

Collins negligently failed to keep a proper lookout, failed to properly apply her brakes, drove too fast, made a left-hand turn in front of the vehicle in which Collins was riding, failed to yield the right-of-way to oncoming traffic and drove without adequate brakes, the complaint says.

Ahart also alleges Minor, the driver of the vehicle in which he was riding, negligently failed to keep a proper lookout, failed to properly apply his brakes, drove too fast and drove without adequate brakes.

Ahart seeks a judgment of more than $100,000, plus costs.

Attorney John H. Hustava, of Collinsville, will represent the plaintiff.
