Man sues Gogreencell and Duc claiming they failed to repay loans

A man claims two companies owe him more than $100,000 after they failed to repay the money lent to them.

John J. Janek Jr. filed a lawsuit Jan. 14 in Madison County Circuit Court against Gogreencell and Duc.

In his complaint, Janek alleges he lent the defendants $145,000 on Sept. 6, 2013. In turn, the defendants promised to repay Janek $2,736.33 on Oct. 6, 2013, and on the 6th day of each of the following 59 months, according to the complaint.

“As direct and proximate result of the aforesaid breach of the promissory note, plaintiff has sustained damages in the amount of $123,274.10 in principal payments, plus interest and late fees per the promissory note and other and further consequential damages recoverable under Illinois law,” the suit states.

Although Janek demanded that the defendants repay him several times, they failed to do so, the complaint says.

In addition to the money he claims the defendants owe him, Janek seeks interest and late fees, plus consequential damages, pre-judgment interest, costs and other relief the court deems just.

Robert L. Jackstadt and Kameron W. Murphy of Tueth, Keeney, Cooper, McHan and Jackstadt in Edwardsville will be representing him.
