Union Pacific sued over carman's alleged hand injury

A man alleges he suffered hand injuries when a machine he was operating on a train malfunctioned.

John Tuey filed a lawsuit Nov. 10 in St. Clair County Circuit against Union Pacific Railroad Company.

In his complaint, Tuey alleges he was working for Union Pacific in its carman craft at the Dupo car shop yard on Nov. 18, 2011, when he attempted to change a brake shoe on a hopper car. While doing so, the shoe bar slipped and Tuey hit his hand on the track frame, according to the complaint.

Because of the incident, Tuey experienced pain and suffering to his finger and hand, incurred medical costs and lost income, the suit states. He also suffered disability and endured emotional damage, including anxiety and depression, the complaint says.

Tuey blames Union Pacific for causing his injuries saying the railroad negligently failed to provide him with a safe place to work, failed to provide adequate training, failed to provide adequate manpower, failed to provide proper equipment and failed to warn of the hazards associated with the work assigned.

In his complaint, Tuey seeks a judgment of more than $100,000, plus costs and other relief the court deems just.

Attorney Douglas B. McKechan, of Cervantes and Associates in St. Louis, will represent Tuey.
