O'Charley's and patron sued over alleged sexual advances

A woman has filed suit against the man whom she alleges made inappropriate sexual advances toward her while he was intoxicated.

Breanna Poston alleges she was at the O'Charley's restaurant at 1313 Central Park Drive in O'Fallon on Nov. 15, 2012, when defendant Piotr Sulewski allegedly approached her and began to touch her in inappropriate places.

"The defendant's inappropriate touching of the plaintiff was the ultimate result of his consumption of the substantial amounts of alcohol causing his extreme intoxication," states the suit filed Nov. 5 in St. Clair County Circuit Court.

Because of the incident, Poston underwent embarrassment, suffered physical and psychological trauma and endured stress, the complaint says.

Poston blames Sulewski for causing her damages, saying he negligently consumed substantial amounts of alcohol, touched her as a result of the extreme intoxication and continued to consume additional alcohol while at O'Charley's.

She also names O'Charley's as a defendant, saying the restaurant negligently supervised its employees, knew of the dangerous nature of Sulewski but failed to properly remove him and failed to properly protect other patrons.

In her complaint, Poston seeks a judgment of more than $100,000, plus costs.

Attorney James R. Williams, of the Law Offices of Williams, Caponi and Associates in Belleville, will represent Poston.

St. Clair County Circuit Court case number: 14-L-740.
