Man blames collision at Belleville intersection on driver's failure to keep proper lookout

A man has filed suit against the driver whom he alleges struck his vehicle.

John G. Schmierbach alleges claims he was driving north on South Illinois Street at its intersection with West Washington Street in Belleville on March 25 at about 1:16 p.m. when defendant Jeremy K. Holle, who was driving south on the same road, struck the driver's side of Schmierbach's vehicle.

Because of the collision, Schmierbach allegedly became sick, sore, lame, disordered and disabled; received leg, thumb, hip and lower back injuries; and incurred medical costs, according to the complaint filed Nov. 10 in St. Clair County Circuit Court.

In addition, Schmierbach's truck, a 2001 Chevrolet K25 pickup, incurred extensive body damage and was deemed a total loss, the suit states.

Holle negligently failed to keep a proper lookout, failed to keep his vehicle under proper control, allowed his vehicle to strike Schmierbach's, failed to reduce his speed and failed to obey a traffic signal, the suit states.

In addition to Holle, Schmeirbach names ARI Fleet as a defendant, saying it employed Holle at the time of the collision.

In his complaint, Schmierbach seeks a judgment of more than $150,000 and $8,200 for his truck, plus other relief the court deems just.
