A Belleville bar is being blamed in a lawsuit filed by two patrons who were allegedly struck by a car while walking in the parking lot.

Plaintiffs Todd Patkus and Andrea Maddox filed the four-count complaint against defendants Cindy K. Lugge and BB Concepts LLC, doing business as Silver Creek Saloon, on Oct. 29 in the St. Clair County Circuit Court.

According to the complaint, Parkus and Maddox were existing the Silver Creek Saloon in Belleville on Sept. 26 when Lugge struck them with her car in the parking lot.

Lugge is accused of negligently driving and operating her vehicle so as to cause injury to the plaintiffs, failing to maintain a proper lookout for pedestrians, operating her vehicle at an excessive rate of speed, driving her vehicle without it being equipped with adequate brakes; failing to properly apply the brakes; failing to give warning with her vehicle’s horn, failing to yield the right-of-way to a pedestrian, failing to keep her vehicle under proper control and failing to stop or swerve her vehicle in time to avoid striking the plaintiff.
Silver Creek Saloon is accused of negligently failing to maintain proper pedestrian or traffic control devices; failing to have in place any signs, crosswalks or other controlling devises to channel pedestrian traffic in a safe manner to and from the parking lot; failing to have any stop signs or yield signs to govern automobile traffic in the parking lot; failing to have any warning or caution signs in the parking lot; failing to have speed limit signs in the parking lot; failing to install or maintain proper lighting and failing to maintain a parking lot in a reasonably safe condition.

The plaintiffs allege they sustained injuries to their bodies, causing him to suffer past and future pain from the injuries.

They also claim they incurred medical expenses and will lose wages as a result of the injuries.

The plaintiffs seek a judgment exceeding $50,000 for all counts, plus costs of the suit.
