Fairview Heights contractor sues couple for alleged unpaid work

A Fairview Heights contractor alleges he has not been paid for more than $63,000 in work done on a couple's house in Troy.

Joe Werner Construction Inc. filed a lawsuit Sept. 16 in Madison County Circuit Court against David and Julie Mears, individually and as trustees of the David Mears and Julie Mears Joint Revocable Trust of February 2012.

According to the complaint, Werner Construction agreed to remodel the Mears' home on Woodland Hills Road in October 2013. The total cost for the materials and labor was expected to be almost $115,000, according to the contractor. While working on the remodel, Werner Construction also allegedly was asked to provide extra materials and work that was not covered in the original agreement. The company alleges the additional costs totaled nearly $40,000, which the homeowners allegedly agreed to pay. 

The Mearses allegedly made several payments on the contract but still owe nearly $64,000 and have refused to pay the balance. Werner Construction seeks the full balance of the account in addition to interest and court fees.

Attorney Kevin T. Hoerner of Belleville represents Werner Construction. They request a jury trial.
