Widow sues deceased husband's estate over Alaska motorcycle accident

A woman has filed a lawsuit against her deceased husband’s estate following a motorcycle collision that occurred in Alaska.

Dawn Ferguson filed a lawsuit June 27 in the Madison County Circuit Court against Zachary Ferguson, as special administrator of Michael T. Ferguson’s estate.

Dawn Ferguson claims she was riding on the back of Michael T. Ferguson’s 2002 Honda motorcycle, which was traveling south on Elliott Highway in Fairbanks, Alaska, on July 7, 2012. Suddenly, Michael Ferguson lost control of the motorcycle and exited the road near a curve, throwing both him and his wife from the vehicle, according to the complaint.

Because of the collision, Dawn Ferguson sustained temporary and permanent injuries, incurred medical costs and was prevented from attending to her usual duties, the suit states.

Dawn Ferguson blames her husband for causing the collision, saying he negligently failed to keep a proper lookout for frost heaves, failed to properly control his motorcycle and failed to keep his motorcycle on the road.

Dawn Ferguson seeks a judgment of more than $50,000, plus costs. She is being represented by Lanny Darr of Schrempf, Kelly, Napp and Darr in Alton.
