The Illinois Department of Labor has filed suit against a local Imo’s Pizza business, alleging it has failed to pay a wage settlement.
A suit was filed May 12 in St. Clair County Circuit Court against Belleville East Pizza Inc./Imo's Pizza and Ryan Noles.
The underlying lawsuit had been filed against the pizza company after workers accused it of violating the Illinois Minimum Wage Law and the Illinois One Day Rest in Seven Act. In turn, the Department of Labor and Imo’s Pizza entered into a settlement agreement Nov. 21, in which Imo’s agreed to make two payments of $33,981.03, according to the complaint.
Imo’s Pizza has allegedly breached the settlement agreement by failing to make any of the installment payments promised therein and, pursuant to its terms, upon said breach, Imo’s Pizza became indebted to the department in the full amount of $67,962.06, the suit states.
In addition to the money it claims it is owed, the department is seeking costs and other relief the court deems just. It is being represented by Assistant Attorney General Patrick W. Fitzgerald of Springfield.
