Azcon Metals claims it has not been paid $1.2 million in scrap

A company claims it has not been paid more than $1 million for scrap metal it sold to a Blue Island business.

Azcon Inc., doing business as Azcon Metals, filed suit April 24 in the Madison County Circuit Court against Metal Recycling Systems Inc., Scott Irvine and Michael Irvine.

According to the complaint, the plaintiff sold and delivered scrap metal to defendant Metal Recycling Systems from 2004 through April 1 on an open account. During the period Feb. 6 through and including April 1, Metal purchased products from Azcon for which it agreed to pay the aggregate amount of $1,213,462.20, the suit states.

Azcon agreed to make all payments within 30 days of the invoice, according to the complaint. However, it has paid none of its February through April invoices, the complaint says.

Although Azcon has demanded repayment of the money owed to it, Metal and its owners, Michael and Scott Irvine, have failed to remit the payments, according to the complaint.

The plaintiff is seeking the money it claims it is owed, plus costs. It is being represented by Joel A. Kunin and Steven M. Wallace of The Kunin Law Offices in Collinsville.
