Truck driver caused rear-end accident on I-55, suit says

A woman has filed suit against the driver she claims rear-ended her vehicle.


Lori A. Flesner and Jon Flesner filed suit April 4 in the St. Clair County Circuit Court against Michael S. Stout, Superior Fuels Inc. and Encore Transportation LLC.

According to the complaint, Lori Flesner was driving south on Interstate 55/Interstate 70 on June 12, 2012, when Stout, who was driving a 2009 International Pro Star tractor-trailer, rear-ended Lori Flesner’s vehicle.

Because of the collision, Lori A. Flesner suffered head, neck, low back and pelvis injuries and endured severe pain and mental anguish, according to the complaint. In addition, she incurred medical costs, has been unable to work and enjoy the ordinary pursuits of life and lost earnings, the suit states.

Due to the collision, Jon Flesner lost his wife’s support, companionship and society, the complaint says.

The Flesners blame Stout for causing the collision, saying he negligently drove too fast, failed to keep a lookout ahead, failed to stop his vehicle, struck the rear of Lori Flesner’s vehicle and failed to reduce his speed when a special hazard existed, the complaint says.

The Flesners are seeking a judgment of more than $200,000, plus other relief the court deems just. They are being represented by Matthew C. Casey of Casey and Devoti in St. Louis and Patrick R. Foley of Williams, Caponi and Foley in Belleville.
