Delivery man sues Shop 'N Save after overhead door falls on him

A man has filed suit against the grocery store where he claims an overhead door fell on top of his head.


Larry E. Ryan filed suit March 14 in the Madison County Circuit Court against Shop ‘N Save Warehouse Foods Inc., doing business as Shop ‘N Save.

According to the complaint, Ryan was making deliveries to the Shop ‘N Save at 2122 Troy Road in Edwardsvile on March 15, 2012, when an employee pushed up the overhead door so Ryan could walk underneath it.

“As the plaintiff was walking under the overhead door, the overhead door came down suddenly and without warning and struck the plaintiff on his head,” the suit states.

Because of the incident, Larry Ryan suffered injuries to his cervical spine, incurred medical costs and lost wages, the suit states. He also suffered mental anguish, emotional distress and disability, the complaint says.

Ryan blames Shop ‘N Save for causing his injuries, saying it negligently failed to warn him of the dangerous condition, failed to warn him of the defective door, failed to maintain the premises in a safe condition, failed to guard against injury, failed to make a safe ingress and failed to repair the dangerous condition.

In addition to Shop ‘N Save, Ryan names the store’s managers as defendants. Additional defendants include Mark Ansell, Carolyn Ballard, Richard Ballew, Gary Thomas and Richard Honieg.

Larry Ryan is seeking a judgment of more than $350,000, plus costs and other relief the court deems just.

He is being represented by Scott A. Friedman of C. Marshall Friedman in St. Louis.
