Passenger involved in roll-over accident files Dram Shop suit against bar

By Kasey Schefflin-Emrich | Jun 18, 2015

A passenger filed a Dram Shop suit claiming a bar patron was negligently over-served alcohol and caused a roll-over collision.

Tiffany Zancha filed a lawsuit on June 4 in Madison County Circuit Court against RDG Holding Inc., doing business as Tomahawk Bar & Grill, County Line Smokehouse Inc. and Gaylord Liening, alleging negligence.

According to the complaint, on June 6, 2014, Shaun Alexander consumed alcoholic beverages at the Smokehouse bar on Route 143 in Bond County to the point of becoming intoxicated. The suit says Alexander then got into a car accident, crashing and flipping his vehicle, on state Route 143 just east of Millersburg in Bond County.

As a passenger in Alexander's car, Zancha alleges she endured serious injures that led her to become disabled and forced her to seek and continue to seek care and treatment from physicians and surgeons. Additionally, the complaint states, as a mother of a minor, Zancha's injures will cause a loss of support to her child as she will be unable to work and has lost and will continue to lose wages that she would have otherwise been able to make if she didn't incur injures from the car accident.

Zancha seeks damages in an amount that would not exceed the statutory limit for injury to their person and property together, plus the costs of the suit and other relief deemed appropriate by the court.

She is represented by attorney George Albers of Roth Law Offices, in Granite City.

Madison County Circuit Court case number 15-L-717.
