Bethalto McDonald’s accuses customer of negligence in slip and fall suit

McDonald’s denied liability in a customer’s slip and fall lawsuit, claiming the customer failed to adhere to the slippery floor warning signs.

Freda Balesmalson field the March 2 lawsuit against Bold Enterprise Inc., doing business as the McDonald’s at 2 Airport Plaza in Bethalto.

She claims she fell at the restaurant at 6:30 p.m. on Nov. 4 on a slippery floor.

She seeks damages between $50,000 and $75,000.

The defendant denied the allegations in its April 6 answer, claiming the plaintiff’s own negligence contributed to her alleged injuries.

McDonald’s accuses her of failing to keep a proper lookout, failing to heed the warning signs placed throughout the store, failing to heed the fact that it was raining and she should have expected the ground to be wet as a result and failing to use the counter as a handhold while walking on the allegedly wet ground.

Balesmalson denied the allegations in her answer to the affirmative defenses.

John H. Hustava of Collinsville represents the plaintiff.

Marcus J. Raymond of Maryland Heights represents the defendant.
