Lawsuit alleging Viagra-related death voluntarily dismissed

After litigating for just one week, the family of a deceased Tennessee man has voluntarily dismissed their lawsuit claiming Viagra caused the decedent to develop melanoma.

Plaintiff Tina M. Stockton filed a motion to voluntarily dismiss the case without prejudice on April 7 through attorney Thomas J. Lech of Goldenberg, Heller, Antognoli & Rowland.

Stockton filed the lawsuit individually and as estate administrator for David G. Stockton on April 2 against Pfizer Inc.

According to the complaint, the decedent began pharmaceutical treatment for erectile dysfunction in 2000. Under his doctor’s advice, he continued to take Viagra until about 2007. He died from pulmonary embolism consequent to metastatic mucosal melanoma on Sept. 9, 2008.

In her complaint, the plaintiff claimed Pfizer did not properly disclose melanoma-related risks in taking the medication. She also argues that if the decedent had known of the risks, he would have limited his usage in duration and dosage.

Stockton sought a judgment exceeding $50,000.
