Couple seeks to dismiss siblings’ lawsuit protesting division of mother’s assets

A couple accused of coercing their mother into signing away her assets to just one child seeks to dismiss a lawsuit, arguing the claims should be made separately against the husband and wife. Daniel Kimme, Rebecca Tabor, Amy Kimme-Hea and Paul Kimme filed the lawsuit on Feb. 25 against Deanne Kimme and Dale Kimme. According to the complaint, Virginia Kimme died on Sept. 10 with no surviving spouse and five children.

Mechanical company denies liability in former employee’s lawsuit over pressurized hydraulic fluid explosion

A mechanical company claims its former employee’s own negligence for failing to wear appropriate gear and failing operate machinery properly were the cause of his alleged injuries when pressurized hydraulic fluid exploded at Olin Corp. in 2013. Mark and Sandra Avant filed the March 30 lawsuit against Kane Mechanical Inc. McDonald’s denied liability in a customer’s slip and fall lawsuit, claiming the customer failed to adhere to the slippery floor warning signs. Freda Balesmalson field the March 2 lawsuit against Bold Enterprise Inc., doing business as the McDonald’s at 2 Airport Plaza in Bethalto. She claims she fell at the restaurant at 6:30 p.m.

A realty center denies liability in a potential home buyer’s lawsuit alleging he was injured while looking at a house with a damaged porch. Timothy Coulson filed the lawsuit on March 2 against Prudential agent Leroy Taylor, Prudential One Realty, Prudential One Realty Centre Edwardsville, the Prudential Real Estate Affiliates, Re/MAX Riverbend Realty, RE/MAX Holdings Inc., Mary Wofford and RE/MAX agent Paula Anderson. Madison County Chief Judge David Hylla anticipates a shortage in available judges next month as he works to fill five open associate judge positions. The positions were left vacant after the elected Third Judicial Circuit judges voted to retain eight of the 13 associate judges. “Their terms end on July 1, so my number one priority is to get their vacancies filled as soon as possible,” Hylla said.

A class action lawsuit was filed against the Village of Swansea, accusing it of charging St. Clair Township residents higher sewer fees than Swansea residents. Plaintiffs Robert Trentman, Dean Wallen and Daniel Varady, on behalf of themselves and all others similar situated, filed the class action complaint against the Village of Swansea on June 5 in St. Clair County Circuit Court. Construction company seeks to strike Alton Housing Authority’s request for attorney’s fees

A contractor accused of installing the wrong doors in an apartment building argues the plaintiffs never notified it of the issues until the lawsuit was filed. The Housing Authority of the City of Alton (AHA) filed the lawsuit on March 27 against Eggemeyer Associates Architects Inc. and Jun Construction Co. According to the complaint, AHA owns property known as the Oakwood Estates public housing units in Alton.

Family Dollar Stores seeks to dismiss a slip and fall case, claiming it does not own or operate the individual store where the alleged incident occurred. Plaintiff Mabel Ellison filed a lawsuit on April 10 against Family Dollar Stores of Illinois Inc., claiming it does business as Family Dollar Store No. 4168 in Alton. She alleges she was a customer at the store on June 8, 2014, when she allegedly slipped and fell on the floor.
