BELLEVILLE – A Michigan woman alleges her late husband's lung cancer was caused by exposure to asbestos.

Phylis Rutledge, individually and as special representative of the estate of Warren Rutledge Jr., deceased, filed a complaint on July 26 in the St. Clair County Circuit Court against Arvinmeritor Inc., A.W. Chesterton Co., CBS Corp., Certain-Teed Corp., Colfax Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that during Warren Rutledge Jr.'s employment from 1963 to 2011, he was exposed to and inhaled asbestos fibers from certain products manufactured, sold, distributed or installed by defendants. As a result, the suit states he was caused to develop lung cancer and died on Oct. 18, 2016. 

The plaintiff holds Arvinmeritor Inc., A.W. Chesterton Co., CBS Corp., Certain-Teed Corp., Colfax Corp., et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks judgment against defendants of more than $50,000 and any further relief as the court may deem appropriate. She is represented by Ethan E. Flint and Laci M. Whitley of Flint Law Firm LLC in Edwardsville.
